An order for goods placed by you, the buyer, through our website shall be subject to these terms and conditions. All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

Orders
 

All orders for goods shall be deemed to be an offer by you, the buyer, to purchase goods pursuant to these terms and conditions. You, the buyer, shall be responsible for ensuring the accuracy of the details provided when ordering and we will not be obliged to accept an order unless all details requested have been entered correctly. No order submitted by you, the buyer, shall be deemed to be accepted by us unless and until we confirm acceptance of the your order by e-mail (where applicable), by telephone or by posting the goods to you. We are entitled to refuse any order placed by you and will not be required to provide an explanation

The images shown on the website are examples of our products but please note the goods may differ slightly from the images shown. 

Price and Payment
 

The price of the goods will be the price quoted on the website at the date the order is received and will include VAT where applicable unless specified otherwise. We reserve the right, by giving notice to you, the buyer, at any time before delivery to increase the price of the goods to reflect any increase in the cost to us, which is due to any factor beyond our control (such as without limitation, any foreign exchange fluctuation, significant increase in the costs of labour, materials or other costs of manufacture). In the unlikely event of there being such an increase in the price of the goods you, the buyer, shall be entitled to cancel the order within 7 days of such notice being given.

Payment and security

A secure server and software ensure all that your personal information is encrypted and protected. We are committed to protecting your privacy and The French Letter Condom Company Ltd will not pass on any of your personal data to any other company. We will only use the information you give us to process your order.

Title to the goods will pass to you, the buyer, on delivery.

Postage and Packaging
 

Postage and Packaging within England, Scotland, Wales and Northern Ireland.

Upon receipt of your order and confirmation of the credit card details, the order will be packed in 48 hours. It will then be ready for dispatch and this is normally done by a Royal Mail delivery to ensure that the parcel is signed for. The cost of the postage and packaging is:

Spend less than £60 £1.49 
Spend £60 or more – p&p is FREE

We will send your order via Royal Mail Air Mail The postage and packaging charge will be £3.99

Delivery
 

The goods will be delivered to you, the buyer, at the address provided by you upon ordering. You may wish to give an alternative delivery address where you know that there will be someone to receive and sign for your package.

Any extra charges incurred by The French Letter Condom Company Ltd as a result of an incorrect address being provided by you, the buyer, must be paid before the goods will be re-dispatched.

Any dates quoted for delivery of the goods are approximate only and we shall not be liable for any delay in delivery of the goods however caused.

Return of goods
 

The French Letter Condom Company Ltd is happy to exchange or refund items within 14 days of the date you received the order, under the following circumstances:

- The goods are still in their original packaging, haven’t been used and are still fit for re-sale.

- The goods have not been personalised for you (for example bespoke packs made to your order).

A full refund for the goods (excluding our postage to you and yours to us) will be made within 10 working days of us receiving back the goods. Please ensure that when you return the goods you send it back to us by recorded delivery. We cannot refund any goods that are lost in the post and that we do not receive back.

You, the buyer, will inspect the goods as soon after delivery as is reasonably practicable and will notify us of any shortages or faults in the goods or any other complaint within 3 working days from the date the goods were delivered. Any item that you receive from us which is faulty (or sent in error) still needs to be returned to us, but we will refund the cost of the goods plus all the delivery costs. Again, please send it back by recorded delivery.

None of the above terms affect your statutory rights.

Your Warranty
 

You, the buyer, warrant that all details provided on the order form for the purpose of purchasing the goods are correct, that the credit card you are using is your own and that there are sufficient funds and/or sufficient unused limit available to cover the cost of the goods.

You, the buyer, also warrant that you will follow the instructions sent with the goods when using the goods.

Our Warranty and Limitation of Liability
 

We warrant that the goods will match the description, if the goods do not match the description we either provide replacement goods or a refund at our discretion.  This warranty is in lieu of and to the exclusion of; all other rights and remedies whether arising under any condition or warranty of merchantability or fitness or satisfactory quality or any other contractual condition or warranty express or implied by statute or otherwise, and/or; any other cause of action in contract or in tort (including but not limited to negligence) or under statute or any other legally recognised cause of action or liability whatsoever.  Nothing in this clause shall seek to limit our liability in respect of death or personal injury.

We will use all reasonable endeavours to carry out our obligations within a reasonable period of time but will not be liable to you, the buyer, for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of these terms and conditions by reason of any delay in performing, or any failure to perform, any of our obligations in relation to these terms and conditions, if the delay or failure was due to any cause beyond our reasonable control. If we are prevented from carrying out our obligations in the above circumstances, we will notify you in writing. If we are still prevented from carrying out our obligations 3 weeks from the date such notice was sent, then either party may give written notice to the other cancelling the purchase/sale of the goods. If cancellation in this way occurs we accept no liability to compensate you for any loss or damage caused by failure to perform

We aim to respond to e-mail, telephone and written queries within 48 hours. In respect of complaints, we will consider the nature of the complaint and will contact you within 21 days of the complaint giving you the result of the enquiries and what we propose should be done.
